General Terms of Use (GTU) - Nutrya (v4.2)

1. Acceptance of terms

By downloading or using the Nutrya application, you agree to be bound by these GTU. If you do not agree, do not use the application.

2. No medical advice and Data Accuracy

Nutrya is a nutritional tracking tool and a cooking aid.

Data Estimation: The information provided (calories, macros, micronutrients, etc.) are mathematical estimates. They are NEVER guaranteed to be 100% accurate. Errors in calculation, database or interpretation by AI may occur.

Health: This data in no way replaces professional medical, nutritional or dietary advice (doctor, nutritionist, dietitian).

User Responsibility: You are solely responsible for the interpretation of the data and your food choices. The publisher cannot be held responsible for the consequences on your health (allergies, deficiencies, poisonings, etc.).

3. Disclaimer of Liability

The application is provided "AS IS".

Use at your own risk: The publisher declines all responsibility for any direct or indirect damage resulting from the use of the application. In the event of a nutritional calculation error or technical bug, the publisher's responsibility cannot be engaged.

AI and Third-party Sources: The publisher does not guarantee the accuracy of data from Open Food Facts, the USDA or generated by AI.

Technical Bugs: No compensation can be claimed in the event of a bug, interruption or temporary or permanent shutdown of the service.

4. Subscriptions and Payments

Subscription Description: Nutrya offers a 'Premium' subscription (Monthly or Yearly) providing full access to all nutritional tracking and AI features of the Application.

Auto-renewal: The subscription automatically renews at the price and duration of the initial period, unless auto-renew is turned off at least 24 hours before the end of the current period.

Billing: Payment will be charged to your Apple ID account at the time of purchase confirmation.

Subscription Management: You can manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase.

Trial Period: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5. Modification and Termination of Service

The publisher reserves the right to modify, suspend or stop the application at any time, temporarily or permanently. In the event of a stop, no refund of current subscriptions can be required. The publisher is not responsible for the retention or loss of your data in the event of service termination.

6. Intellectual Property

All elements of the application (code, design, logos, contents) are the exclusive property of the publisher and are protected by intellectual property laws.

7. Modification of Conditions

The publisher may modify these GTU at any time. By continuing to use the application, you accept the updated version.

8. AI Fair Use Policy

The Application offers innovative features based on Artificial Intelligence (voice query analysis, image analysis, text generation). In order to guarantee optimal, fast, and continuous service quality for all our users, and to prevent any abusive use, these features are subject to a fair use policy.

Specifically, the use of these AI tools is subject to internal daily quotas. These limits are intentionally set at a very generous level to broadly cover the needs of normal, personal daily use of the Application. These quotas are reset every 24 hours.

In the event that this reasonable daily limit is exceeded, access to these specific AI features may be temporarily restricted until the following day. The Publisher reserves the right to modify these thresholds at any time to preserve the technical stability and fairness of the service.

9. Governing Law and Jurisdiction

These GTU are governed by French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of the French courts.
